Construction in Indian Country | Labor and Employment Issues

Construction Statute of Limitations | New Things You Should Know

1.0 Standard CLE Credit

In this CLE, Construction Section members and former Section Chairs Jennifer Thompson and Mark Becker will discuss the ins-and-outs of the construction statute of limitations.  Jennifer and Mark will discuss the new Minnesota Supreme Court case of Moore v. Robinson Environmental, in which Jennifer and Mark filed an amicus brief on behalf of the section.   The Supreme Court provided important clarifications to the statute of limitations that Construction Section members need to know.  Jennifer and Mark will also discuss the Supreme Court’s invitation for Section participation in the case and MSBA processes for amicus participation.

Weed on the Worksite

When Minnesota “accidentally” legalized some forms of THC last year, it made recreational marijuana legalization all but guaranteed. This raises a not insignificant amount of questions for the construction industry. Can employers prohibit all marijuana use for safety sensitive positions? What happens if an employee tests positive? What if we find marijuana at work? What happens if an employee gets injured at work and we hear rumors they were high?
