Access Rights and Severance Damages in Eminent Domain after State by Comm’r of Transp. v. Elbert

Event Description

This eminent domain CLE will discuss the issues, arguments, and holdings presented in the recent Minnesota Supreme Court decision, State by Comm’ r of Transp. v. Elbert, 942 N.W.2d 182 (Minn. 2020). The presenters will offer background and analysis of the Supreme Court’s treatment of access rights and severance damages in partial takings cases in Minnesota, and discuss other aspects of the decision from both the public and private practice perspective.
