Program Description:
Intimate partner violence, coercive control and other
issues can have major implications for parties’ ability to mediate or to engage
in other facilitative dispute resolution processes. Under some
circumstances, however, mediation can be a safe process that produces safe and
workable parenting or financial arrangements if the process is modified to
address the issue(s). A new national resource, the Mediation Discussion
Guide, was developed to assist ADR providers and family lawyers to structure a
dialogue that helps parties assess whether participation in mediation is right for them in
view of their own circumstances and in consideration of the short- and long-term
safety and well-being of family members. Last year the Hennepin County’s Family
Court Enhancement Project issued a guidance recommending that attorneys and mediators address the five areas
of inquiry covered by the Discussion Guide. This session will
equip practitioners to employ the Guide and to competently screen for DV
and assess its implications for ADR.
