An employer's request for, or use of,
an employee/candidate's medical records raises a host of complicated legal
issues and questions under the non-discrimination laws. Many employer employers
request medical information for many different reasons; both legal and sometimes
illegal. In addition to providing a basic primer, this CLE is aimed at examining
when an employer's request or use of medical information goes "too far" and runs
afoul of the non-discrimination laws. The panelists will provide examples of
what is and is not acceptable language in medical inquiries and requests
pre-offer, post-offer, and when an employee requests a reasonable accommodation
or FMLA leave. In addition, the panelists will discuss the rules and limitations
of medical authorizations and record requests under the Americans with
Disabilities Act (ADA), the Genetic Information Non-Discrimination Act (GINA),
and how the limitations and requirements of those acts interest with other state
and federal laws.
Investigator Trainings are sponsored by the MSBA
Labor & Employment Section and planned for the benefit of investigators at
our governmental agencies.
Lunch will be provided. Lunch and
registration begin at 11:45 a.m.
