Description:
Health insurance has long
been understood to cover most forms of "medically necessary" health care. But
who gets to decide whether particular medical interventions for individual
patients are indeed "medically necessary" and hence covered? In his talk,
Professor Schwarcz will argue that health insurers are increasingly avoiding
legal and regulatory constraints on their medical necessity determinations by
altering their insurance policies to include detailed rules for what types of
care they deem to be medically necessary. This ongoing shift in insurance
policy structure dramatically limits the capacity of law and regulation to guard
against the risk of insurer overreaching. He will also explore how federal and
state actors can push back on these insurer efforts to avoid legal oversight of
their medical necessity determinations. Professor Schwarcz's talk will be based
on his recent article, Rules of Medical Necessity, 107 Iowa Law Review 423
(2022), which is co-authored with Professor Amy Monahan at the University of
Minnesota Law School and freely available for download at this
link.
