Alternative legal service providers (ALSPs) leverage niche
expertise and technology to support law firms, legal departments, and consumers
with services not conventionally associated with law firm operations (i.e., data
analytics, electronic discovery, document review, compliance, contract lifecycle
management, etc.). Growth in this area have some saying maybe we should drop
“alternative” from the label. This is especially so considering growth among
so-called, ‘law firm captives’ – those firms and legal departments who are
building these services from within.
Whether it’s a captive entity or a consumer service like
LegalZoom, ALSPs are taking lawyers to places they
haven’t gone before; namely, new markets where proficiency in a broader array
of non-traditional skills is critical. Thus, a few academics are developing new models
of lawyer competency. In particular we’ll review the ‘T’-shaped lawyer and the
Delta Model of Lawyer Competency. How do attorneys develop these competencies?
Or, how do attorneys ethically partner with non-lawyer experts to support
the delivery of services? Are new regulatory environments required? We’ll take
a look at Utah’s Regulatory Sandbox to examine how firms are taking advantage
of a new regulatory environment to partner with non-attorney professionals.
