A certain pop singer’s recent court
battle to be “free” from a conservatorship has brought public and professional
attention to this area of law. Legal pundits to celebrity gossip talk show
hosts have weighed in on whether adults should be subject to a guardianship or
conservatorship. Recently the American Bar Association passed a resolution
calling on the United States Congress to develop better protections for persons
who are or may be subject to a guardianship proceeding. U.S. Senators
Elizabeth Warren and Bob Casey have called on the Department of Health and Human
Services and the Department of Justice to provide information about the
prevalence of guardianship in the U.S. These calls for change are prompted
by the increased attention on guardianship/conservatorship cases particularly
those cases in which contested issues develop. Understanding the issues
that lead to contested cases and how those cases proceed in court is crucial to
being an informed participant as this area of law is being examined and
potentially reformed.
During this CLE co-sponsored by the MSBA Elder Law Section and
MN-NAELA, attorneys Spencer Butts and Sarah Sicheneder will
discuss:
• The court process of uncontested v. contested
cases;
• Circumstances that lead to contested cases;
• The role
of the attorney in contested cases;
• Legal protections for persons
subject to guardianship and conservatorship; and
• Dispute resolution
alternatives to contested hearings and
trials.
