The MSBA Elder Law Section sponsors this annual CLE focusing on current and emerging issues related to long-term care, particularly in assisted living and nursing home settings. 

Two main issues have imminent and significant impact on long-term care in Minnesota:  1) COVID-19; and 2) assisted living licensure. Vaccination against COVID-19 in long-term care settings is mostly complete, and guidelines and best practices are once again shifting rapidly. The introduction of assisted living licensure effective August 1, 2021 has implications for the state health department, residents, and providers that are important for attorneys and the public to understand.

Deputy Ombudsmen from the Minnesota Office of the Ombudsman for Long-Term Care will identify trends in the impact of COVID-19 and upcoming assisted living licensure upon residents of long-term care facilities, specifically addressing visitation, terminations, and discharges.  The Health Facilities Section Chief and the Interim Reconsideration and Policy Manager of the Minnesota Department of Health will address impacts of COVID-19 and plans for implementing and monitoring the transition to assisted living licensure. The President of an assisted living provider in greater Minnesota will share a provider’s perspective on the transition to assisted living licensure, including changes necessary to comply with license obligations and anticipated impact on residents.

Throughout the CLE, the moderator and panelists will introduce tips for attorneys helping their clients navigate these issues. The CLE will also offer updates on any significant developments in pending legislation impacting long-term care.
