Chapter 11 bankruptcy is not just for
large corporations or high net worth individuals anymore. The new
sub-Chapter V of chapter 11 offers a quicker and more cost-effective bankruptcy
option to debtors who might otherwise resort to liquidation under chapter 7 or
dissolution under state law. Learn who qualifies to use subchapter V, the
basic timeline of a subchapter V case, the new role of subchapter V Trustees,
and the new confirmation standard. We will also discuss new bankruptcy
legislation intended to assist small businesses affected by the pandemic. The
panelists have worked on several local subchapter V cases as trustees, debtor's
counsel, and/or creditor's counsel, and they offer a variety of perspectives
about the pros and cons of proceeding under the new
scheme.
