Wild West 2.0 - How Attorneys are Solving Commercial Leasing Problems During the COVID-19 Pandemic

COVID-19 and resulting government orders have dramatically impacted commercial landlords and tenants. The pandemic has led to a rash of nonpayment-of-rent litigation and raised questions about how attorneys should draft, interpret, and enforce commercial leases, as well as how both tenants and landlords can try to anticipate pandemic-related issues in new contracts. In this program, a panel of two commercial litigators (Heather Marx from Cozen O’Connor and Phil Kaplan from Anthony Ostlund) and a transactional attorney (Christine Eid from Stinson Leonard Street) will discuss commercial leasing issues that have come to the forefront due to COVID-19, including force majeure clauses, impracticability/frustration of purpose defenses to contract obligations, and contract drafting and litigation strategies landlords and tenants are using to navigate the crisis and beyond.
