The HCBA Landlord Tenant Section and the Volunteer Lawyer
Network are co-sponsoring this timely CLE program. In Central Housing Associates v. Olson, 929
N.W.2d 398 (Minn. 2019) the Minnesota Supreme Court promulgated a new,
common-law retaliation defense residential tenants can assert in an Eviction
Action (“UD”) while also slightly limiting the reach of Minn. Stat. § 504B.441.
This CLE seminar, by one of Mr. Olson’s attorneys, will review that case as well
as other retaliation defenses – First Amendment defenses, reprisal defenses
under the FHA & the MHRA, defense under Minn. Stat. § 504B.205, and defenses
under Minn. Stat. § 504B.285, plus a city ordinance -- along with associated
case law. The CLE will conclude with suggestions, including draft pleadings, for
tenant-initiated lawsuits to stop retaliatory evictions. Materials will include
a PowerPoint, copies of statutes, the draft pleadings, and some hard-to-find
court documents underlying Cloverdale Foods v. Pioneer Snacks, 580 N.W.2d
46.
