Lawyering In The Age of Social Media

This program will discuss how the Minnesota Rules of Professional Conduct interact with a lawyer’s use of social media. An overview of the rules that impact conduct will include Competence, Confidentiality of Information, Conflict of Interests–Current Clients, Trial Publicity (Extrajudicial Statements), Truthful Statements, Communication with Represented Parties, Impartiality and Decorum of Tribunal, Judges and Legal Officials among others.

In addition to review of ethics rules, this program will also deliver general discussion on topics including:

• Conflicts, Trial Publicity and Deception
• “Friend” Requests and Contacts
• Researching Jurors
• Statements about Judges | Legal Officials
• False Statements
• Potential Pitfalls of Social Media Use and Technology

The program will provide an overview of Minnesota’s lawyer discipline system and OLPR along with resources available for attorneys.
