Emerging Issues in Long-Term Care 2023

This annual CLE focuses on current and emerging issues related to long-term care, particularly in the assisted living and nursing home settings, that are of interest to Elder Law attorneys and related professionals as well as the clients they serve.

Get a pulse of what is going on in long-term care facilities from the Minnesota Department of Health (“MDH”) and professionals and attorneys working in the long-term care setting.  MDH will provide an update on proposed legislation, proactive measures and lessons learned from investigating maltreatment reports, and the impacts of staffing shortages in long-term care facilities.  Housing is another focus, with discussion of assisted living termination and appeals process and examples.  In addition, panelists will discuss the application of landlord tenant law to various settings, subsidized housing, and legislative updates on housing.  Long term care insurance will also be a focus, with a discussion of enforcement and litigation trends, including an overview of a current class action and other the successes, concerns, and trends related to securing coverage, which is needed now more than ever.

As possible, we will give a broad overview and update on DHS timelines for renewing medical assistance benefits in light of the upcoming lifting of the national public health emergency.

This CLE sponsored by the Elder Law Section will address these topics to help elder law attorneys and professionals navigate legal concerns on behalf of older and vulnerable adults.
