Over the past twenty years, changes in Presidential
administrations have typically led to changes in Federal environmental
regulations, often with a new administration seeking to alter the regulatory
landscape set by the prior administration. The Administrative Procedure Act
(APA), however, presents a hurdle that any rule change must surmount and can provide a
check against ill-conceived changes. We have brought together an extraordinary panel of national experts on environmental
law and the APA. They will provide an overview of APA
requirements, as well as highlight recent examples of when the federal courts have found
the Trump EPA’s regulatory change efforts have and have not passed
muster with the APA requirements. The panel will also discuss how
these decisions may provide a road map for environmental rule
making by future administrations.
