Can Tech Make Litigation More
Diverse: Using Legal Analytics to Benchmark and Assess Gender Diversity in the
Law
Law firms now realize
that improving diversity and inclusion is not just important to securing
business from sophisticated clients, but is the right thing to do.
Unfortunately, traditional diversity metrics consisting of male/female and
partner/associate headcount fail to account for the substance of work assigned
to attorneys. As Judge Scheindlin wrote in the New York Times last summer, trial
teams before her often consisted of two male and two female attorneys, but the
men would do all the talking. Judge Scheindlin would ask the women to speak-up
in her court. Similarly firms are being asked to provide more holistic measures
of gender diversity beyond head-count.
Can technology help? Legal analytics can
identify the litigation roles of individual attorneys and their gender,
providing a more holistic evaluation of gender diversity. Aggregating data
across many cases, legal analytics can identify law firms committed to gender
diversity. In this talk, we will present Docket Alarm's methodology and findings
across the United States Supreme Court and specialized patent courts.
