"Minnesota Residency Law Update"
The legal landscape relating to taxation of individuals who have changed their domicile to other states is in a state of flux. Over the past year, the Minnesota Supreme Court considered three appeals (Larson, Mauer, and Bradison), which challenged the Department of Revenue’s and Minnesota Tax Court’s current interpretation of the statutes and rules relating to residency. Also significant is legislation that had been proposed by Governor Dayton, which, if proposed again and passed, may significantly alter the law relating to taxation of domiciliaries of other states. This presentation will offer an overview of the current statutes and regulations relating to residency and provide a detailed analysis of the impact of the Larson, Mauer, and Bradison opinions and potential changes in legislation.
