Terms of Use and Community Code of Conduct

Date last modified: February 4, 2022

The Minnesota State Bar Association services, including (without limitation) our websites and other interactive properties through which the services are delivered are owned, operated, and distributed by the Minnesota State Bar Association and are made available by the MSBA subject to these Terms of Use and Community Code of Conduct (“Terms of Use”). These services include, but are not limited to, www.mnbar.org, the MSBA Communities page at https://my.mnbar.org/home, the Hennepin County Bar Association (“HCBA”) website, and the Ramsey County Bar Association (“RCBA”) website (collectively, the “Service”)

These Terms of Use apply to all Users, including Users who are simply viewing content available via the Service or utilizing free Service (“Public Users”), and Users who have engaged for paid Service (“Member Users”) (collectively, “Users,” “User,” or “you”). Not all terms shall apply to all types of Users where specified in the Terms of Use.

By accessing any part of the Service, you are agreeing to the terms and conditions described below (the “Terms of Use”), THE COMMUNITY CODE OF CONDUCT (“CODE OF CONDUCT”), AND THE TERMS AND CONDITIONS OF OUR PRIVACY NOTICE  (the “Privacy Notice”), WHICH ARE INCORPORATED HEREIN BY REFERENCE. If you do not agree to any of these terms, you should not use the Service. If you are otherwise engaged with the MSBA for specific Service through a subsequent or alternative agreement, that agreement may control and supersede these Terms of Use if specified in that document. PLEASE READ THESE TERMS OF USE CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT CONTINUE TO ACCESS OR USE THE SERVICES AND DO NOT REGISTER FOR A MEMBERSHIP.

We reserve the right to refuse a User’s access to the Service for any reason, at our sole discretion. In addition, at our sole discretion, we may suspend or terminate a User’s account for any reason. Such termination of your account will result in your loss of access to the Service. We will not be liable for any decision to suspend, terminate, or refuse Service under any circumstances.

The Service is controlled and offered by us from our facilities in the United States of America. Except as indicated in these Terms and the Privacy Notice, we make no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

COMMUNITY CODE OF CONDUCT

By joining and using the Service, you agree that you have read and will follow the rules and guidelines laid out in these Terms of Use and this Code of Conduct. You also agree to reserve discussions and shared files and content to that best suited to the medium. This is a great medium with which to solicit the advice of your peers, benefit from their experience, and participate in an ongoing conversation.

Please take a moment to acquaint yourself with these important guidelines. If you have questions, contact the member services department. In order to preserve a climate that encourages both civil and fruitful dialogue, we reserve the right to suspend or terminate membership on the Service and/or in the specific Community pages for anyone who violates this Code of Conduct or the Terms of Use.

When engaging in the Community, follow these basic rules:
  • Don't challenge or attack others. The discussions and comments are meant to stimulate conversation not to create contention. Let others have their say, just as you may.
  • Don't post commercial messages on any discussion list, resource library entry, or other area where others might see it. Contact people directly with product and service information if you believe it would help them.
  • Use caution when discussing products. Information posted on the lists and in the libraries is available for all to see, and comments are subject to libel, slander, and antitrust laws.
  • All defamatory, abusive, profane, threatening, offensive, or illegal materials are strictly prohibited. Do not post anything that you would not want the world to see or that you would not want anyone to know came from you.
  • Please note carefully all items listed in the other portions of this Terms of Use, particularly regarding the copyright ownership of information posted.
  • Remember that other participants have the right to reproduce postings to this site unless you specify otherwise.
  • Post your message or documents only to the most appropriate lists or libraries. Do not spam several lists or libraries with the same message.
  • All messages must add to the body of knowledge. We reserve the right to reject any message for any reason.
When engaging in the discussion groups, pleas follow this basis etiquette:
  • Include a signature tag on all messages. Include your name, affiliation, location.
  • State concisely and clearly the topic of your comments in the subject line. This allows members to respond more appropriately to your posting and makes it easier for members to search the archives by subject.
  • Include only the relevant portions of the original message in your reply. Delete any header information, and put your response before the original posting.
  • Only send a message to the entire list when it contains information that everyone can benefit from.
  • Send messages such as "thanks for the information" or "me, too" to individuals--not to the entire list. Do this by using the "Reply to Sender" link to the left of every message.
  • Do not send administrative messages, such as remove me from the list. Instead, use the web interface to change your settings or to remove yourself from a list. If you are changing e-mail addresses, you do not need to remove yourself from the list and rejoin under your new e-mail address. Simply change your settings.
  • Warn other list subscribers of lengthy messages either in the subject line or at the beginning of the message body with a line that says "Long Message."

You are solely responsible for making sure that you have all rights in the User Content, including the rights necessary for you to grant us the licenses to the User Content described in these Terms of Use. By agreeing to these Terms of Use, you represent and warrant that you are the lawful owner of any submitted User Content, or to the extent you are not the lawful owner, you have all rights necessary for you to provide, upload, and make available on the Service the User Content and license it as specified in these Terms of Use.
