In the past, the Pro Bono Committee of the Elder Law Section, working alongside several other organizations, has done an excellent job in organizing, sponsoring and planning various events throughout the state to provide free assistance to those wanted to appoint a health care agent and make their wishes known regarding their health. This year the Minnesota Network of Hospice and Palliative Care (formerly Hospice Minnesota) is the lead event organizer. Participation from our members is still needed as we work together to provide this service. Many local events remain the same, such as the event listed in recent E-Newsletters at William Mitchell College of Law on April 16. Another large event is planned for April 15 at the Mall of America. However, when a husband and wife are living together, they are jointly and severally liable for necessary medical services and necessary household supplies used by the family. Most credit card debt would not fit under the exceptions. This is also very helpful when one spouse dies leaving unpaid debts. <br> <br> Effective May 1, 2011, banks cannot freeze many federal benefits in bank accounts. The Treasury rule applies to Social Security; Supplemental Security Income (SSI); VA benefits; Federal Employee Retirement System benefits; Civil Service Retirement System benefits; and benefits administered by the Railroad Retirement Board. The rule only applies to benefits that are directly deposited into the account and provides uninterrupted access to at least two (2) months of benefits. <br> <br> This is extremely helpful as many seniors only have income from exempt sources. Many banks charge non-refundable fees ($75 to $100) each time an account is attached even if the funds in the account are all exempt. Further, the funds used to be frozen until the debtor provided proof that the funds were exempt to the creditor. This process takes several days or weeks leaving the elder without access to their only income while NSF fees accrue. If the elder did not respond and file an exemption claim, the bank would send their exempt funds to the creditor. Unless the<br> bank agreed to waive the fees and NSF charges the elder could end up owing hundreds of dollars to the bank even though ALL of their income was exempt under federal law. In addition, they did not have access to their funds to pay rent or buy food and medications during the process. <br> <br> If an elder is served with a Summons and Complaint on a debt they can send the creditor two (2) recent bank statements to prove that their funds are exempt from attachment or levy. Many<br> sources of retirement income are exempt under state or federal law. Further, there are no limits on the length of time federal benefits (Social Security, VA or Railroad Retirement benefits) are protected as long as they are traceable to the exempt source. If a creditor attached an account after receiving proof the funds are all exempt they would be acting in bad faith and subject to a penalty under the statute. They may also be subject to a lawsuit under the Fair Debt Collection Practices Act (FDCPA.)
