"Boumediene Three Years Later: All Sound and Fury...?"

 

The U.S. Supreme court, in its most important ruling in a “war on terrorism” case, Boumediene v. Bush, decided that the detainees held by the U.S. military at Guantanamo Bay, Cuba, have a constitutional right to test in American courts their prolonged confinement.  Lyle Denniston will discuss the Court’s bold claim to a seat at the table in developing U.S. detention policy, the fundamental questions the decision raises about American constitutionalism amid a war of unending duration, and whether the reaction of the political branches and the lower courts to Boumediene has essentially drained the decision of substance.

Lyle Denniston has been a journalist for 63 years, covering the U.S. Supreme Court for 53 years. He has covered one out of every four Justices to ever sit on the Court, and has covered the entire career on the Court of 11 of the 112 Justices. Denniston worked for The Baltimore Sun for 19 years and The Boston Globe for 3 years. He now covers the Court for SCOTUSblog, an internet-based clearinghouse of information about the Supreme Court's work. Denniston has published widely in periodicals and newsletters and is a frequent lecturer on the U.S. Supreme Court. He is author of The Reporter and the Law: Techniques of Covering the Courts, the standard manual used in newsrooms and in academic journalism throughout the nation.
