Common law fraud claims are basic to the general litigator’s toolbox but care must be taken to distinguish actionable fraud from various nonactionable types of misrepresentation, “puffery,” and related behaviors.  The concept is flexible enough to fit a variety of circumstances, but is subject to a wide variety of attacks as well.
