In Walsh
v. U.S. Bank, the Minnesota Supreme Court decided whether the plausibility
standard of Twombly and Iqbal or the traditional pleading standard governs civil
pleadings in Minnesota, under Minn. R. Civ. P. 8.01. The court held that the
traditional pleading standard governs, even though identical language in the
Federal rules applies a plausibility standard.
Counsel for plaintiffs and respondents will review the
decision and discuss the implications for civil practice and pleading standards
in Minnesota.
