Cases Before the U.S. Supreme Court
Can an appeal be taken from denial of plan
confirmation? Who gets the money in the trustee’s possession when a
chapter 13 case is converted? Can a junior mortgage be stripped in a
chapter 7 case? Can a fee application include fees for defending a fee
application? What is the scope of Stern v. Marshall, and can the parties consent
to entry of final judgment by a bankruptcy judge? All these issues are currently
before the U.S. Supreme Court and will be discussed at the May 19th MSBA
Bankruptcy Section meeting.
