Minnesota is a leading
agricultural and cooperative business state. Recently, a number of nationwide
antitrust lawsuits have focused on agriculture, including cases involving the
mushroom, cranberry, potato, egg, and dairy industries. One of the central issues in most of
these cases has been the limits of the Capper-Volstead Act, which has exempted
agricultural cooperatives from federal antitrust laws since 1922. Framers of the Capper-Volstead Act sought
to empower farmers to bargain more effectively and to bring their products to
market more efficiently. However, as the size and success of
agricultural cooperatives has increased, concerns about monopolization have been
raised, as highlighted by a series of workshops hosted in 2010 by the Antitrust
Division of the U.S. Department of Justice and the U.S. Department of
Agriculture that focused on competition in the agriculture industry. Presenters will
discuss current agricultural antitrust actions in U.S. District Court and the
relevancy of the Capper-Volstead Act to today’s
agriculture.
