This presentation will focus on the trustee’s ability to
sell or assign litigation claims in bankruptcy including state-law fraudulent
transfer / avoidable transactions claims, other claims arising under state law
and bankruptcy-specific
causes of action. While the 8th Circuit has not ruled
on the issue, there is a split of authority among the
circuits that generally favors the sale of state law claims but not bankruptcy-specific causes
of action. A recent ruling by the district court upheld the
bankruptcy court’s ability to authorize the sale of state law fraudulent transfer / avoidable
transaction claims in Minnesota.
