Children and Predatory Offender Registration in Minnesota - Recent Proposals for Legislative Reform

Under Minnesota law, children as young as 10 years old can be required to register as predatory offenders. In 2021, the Minnesota Legislature enacted the creation of the Predatory Offender Statutory Framework Working Group to comprehensively assess the predatory offender statutory framework” in Minn. Stat. § 243.166. The working group submitted its report to the Legislature on February 1, 2022, and there has been press coverage regarding that report. One of the recommendations is to enact legislation to remove the statutory requirement that youths with an applicable juvenile adjudication register as predatory offender but retain registration requirements for those youths certified as adults (ages 14-17) who are then convicted of an adult offense requiring registration.

Speakers:

Stacy L. Bettison is an Attorney at Kelly, Wolter & Scott, P.A. Ms. Bettison is a co-chair of the Working Group and wrote an article published in Bench and Bar entitled “The New Scarlet Letter: Is Minnesota’s Predatory Offender Registry helping or hurting?” available here. Ms. Bettison also authored another article for the Bench and Bar entitled “Momentum builds for changes to Predatory Offender Registry,” available here .

Mackenzie Boland is an Associate Attorney at Lanners & Olson, P.A. Ms. Boland is the author of Note published in the University of St Thomas Law Journal entitled “Are Child Sex Offenders Truly Predators? Proposed Change to the Minnesota Legislature Requiring Mandatory Sex Offender Registration for Juveniles,” available here.

Angela Kiese is an Assistant Attorney General at the Minnesota Attorney General’s Office. Ms. Kiese is a co-chair of the Working Group.
