The Shifting Jurisdictional Landscape in Indian Country: SCOTUS’s Decision in Oklahoma v. Castro-Huerta

In this event, taking place during Native American Heritage Month, Andrew Adams III and Arielle Wagner will discuss the U.S. Supreme Court’s recent 5-4 decision in Oklahoma v. Castro-Huerta, ruling that states have jurisdiction to prosecute crimes committed by non-Natives on Native land. Learn about the historical context of the decision, Justice Kavanaugh’s majority opinion and Justice Gorsuch’s vigorous dissent, the landscape in Minnesota, and possible consequences of the decision here and elsewhere.

 

Panelists:

Honorable Andrew Adams III, founding member of Hogen Adams PLLC, is a citizen of the Muscogee (Creek) Nation, member of Tylahasse Wykokaye Ceremonial Grounds, and currently serves as Justice of the Muscogee (Creek) Nation Supreme Court and Justice on the Gun Lake Tribal Supreme Court. Andrew practices in areas including federal Indian law, tribal treaty rights, tribal constitutional law, tribal governance, litigation, business law, and employment law.

Arielle Wagner, from the law firm of Lockridge Grindal Nauen PLLP, is from the Lake Vermilion Reservation in Tower Minnesota and is a citizen of the Bois Forte Band of Lake Superior Chippewa. Arielle concentrates her practice in her firm’s antitrust, data breach, and tribal government representation groups and represents consumers, small business, and tribes in complex litigation nationally.
