Discussion will focus on delivery provisions in commercial real estate transactions – drafting for objective and subjective criteria, and an outlook on how the current and future force majeure provisions in the age of COVID-19 and its governmental restrictions may affect those provisions.  (Note: This is not intended to be a complete or in-depth analysis of whether COVID-19 applies as a force majeure circumstance.)
