Live Webinar Description:

Mediation can be an effective way to resolve construction disputes. Increasingly, however, parties treat the mediation session as the first opportunity to address the key disputed issues, often resulting in an impasse and then followed by litigation or arbitration. Based upon a nationwide survey of construction litigators, this CLE will offer concrete recommendations on mediator preferences, mediation timing, pre-mediation preparation and communication, mediation structure and post-mediation communication. This CLE will also introduce an analysis of a survey of more than 200 arbitrators concerning their practices and preferences, including recommendations for persuasive advocacy techniques in complex, commercial arbitrations.
