Description:

Separating the real estate and the equity within can be a difficult process to navigate. Whether divorcing parties want to remove a name from a current loan, buyout a spouses equity in the home, or the exiting spouse wants to purchase a new home, the timing on these mortgage transactions can be critical and clients can get led down the wrong path with poor information on many aspects of this uncoupling (or new purchase) process. We will discuss language to be included in a final decree, how child support and/or spousal maintenance need to be structured in order to be used as qualifying income for their mortgage, and how a Qualifying Name Delete Assumption can be used to avoid a refinance.
