Using Genomics in Environmental and Toxic Tort Litigation

Genetic data has already transformed criminal forensics, paternity disputes, and pathogen tracking. Environmental and tort litigation are next, and the impacts will be even more profound.  Change is arriving rapidly because of the flood of data generated regarding genes and cancer, and the power of machine learning and AI to spot patterns that humans could never find.  These and other advances are helping to address major data gaps and uncertainties about the health risks of most potentially toxic substances, and are even shedding light on whether a specific chemical did or did not cause an injury such as cancer in a toxic tort or environmental exposure/cancer cluster lawsuit, or a product liability case.  Discovery and evidentiary rulings are also emerging.  Factors including "predisposition" or "susceptibility” and the role of "somatic signature mutations" have many potential applications to these cases.  Join us for a presentation by two experienced attorneys who will explore examples of the use of genomic science and will discuss future possibilities.
