This year's Construction Law Annual Symposium will focus on performing construction work for government projects. The Section will also vote on next year's Construction Law Council.

8:30 am - 9:30 am - Battling for Contracts - Handling Bid Disputes

Betsy Hayes, Jim Cownie, and Bob Huber will discuss how the State of Minnesota, local governments, and contractors will approach the inevitable bid protests and disputes that will accompany the record number of upcoming contract lettings likely to result from the massive infrastructure funding being proposed. Learn about ways to navigate the process in a way that helps avoid situations that may prompt a need to formally protest a procurement.

9:30 am - 10:30 am - Equity in the Procurement Process

Betsy Hayes and Igbal Mohammed will discuss how the State of Minnesota is working to promote equity and inclusion in its contracting practices. The presentation will cover legal considerations as well as an overview of the tools, techniques and statutory authorities the State is utilizing to remove traditional barriers for businesses that experience underutilization.

10:30 am - 11:30 am - Resolving Contract Disputes - Using Traditional and Not So Traditional Approaches

John Harens, Jack Van de North, Pamela Whitmore and Alex Hontos will identify some of the unique and counter-intuitive aspects of resolving disputes with public agencies.  Government construction contracting is, in short, different from commercial construction contracting.  When resolving disputes arising from public projects, parties must be aware of exhaustion requirements, the interplay of data-practices laws, whether they are negotiating with public officials with the requisite authority, and the availability of ADR in resolving public disputes.
