Labeling an agreement covering the
financing of personal property as a lease doesn’t make it so. To ascertain
whether an agreement is a true lease or a disguised security agreement, courts
must look to state law. In the context of treatment in bankruptcy, the
determination is often significant. However, courts haven’t necessarily been
consistent in addressing what circumstances are dispositive. We’ll explore the
legal authority on this topic and discuss what factors are typically
examined.
