The Employee Benefits Section of the Minnesota State Bar
Association wants to assist legal aid attorneys by providing a free seminar
that gives an overview on employee benefits issues related to private employers.

In the U.S., benefits are often based on
employment. This session will review ERISA and the Internal Revenue
Code, the two primary federal laws that govern benefits the employers offer
employees. The session will provide an overview, look at how employees
can bring claims for benefits, and an employee’s ability to being a legal
action under ERISA.

Qualified Domestic Relations Orders
(QDROs)
One significant aspect of divorce is the
allocation of a couple’s retirement benefits. This session will review
domestic relations orders for both defined contribution plans (such as 401(k)
plans) and for defined benefit plan (pension plans). It will review
methods for dividing benefits and points to
consider.

11:30 AM - Affordable Care Act – Know Your
Rights
The Affordable Care Act (ACA) does not
require employers to offer health insurance, but does provide a number of
protections for employees. This session will look at those protections, from
employer notification regarding the availability of coverage under the health
exchanges to section 1557 of the
ACA.

Rules
The loss of a job does not necessarily mean the loss of health insurance. This session will
look at the COBRA and Minnesota state law which provide protection to
allow employees to elect to continue coverage under an employer’s health
plan upon termination of
employment.
