11 USC § 523(a)(6) involves the exception to discharge for intentional acts. The code section has a colorful history involving medical malpractice, gunshots and all other types of mayhem. Breach of contract has seldom been considered to be an intentional act as breach of contract can be found without a finding of intent. However, there has been a groundswell of cases throughout the country that have found, on various theories, that breach of contract claims can be exempt from discharge under § 523(a)(6).  The presentation will present the history of Section 523(a)(6) and examine how the ambiguity that still exists in how that statute is interpreted has contributed to an increased willingness of bankruptcy judges to except certain contract claims from discharge.
