Our topic this week is the Diploma
Privilege: Anticipating a delayed Bar Exam, The Minnesota State Board of Law
Examiners filed a petition on April 20, 2020 proposing to broaden the scope of
the Student Practice Rules by allowing recent law school graduates to practice
under the supervision of a licensed attorney. Proposed amendments include
eliminating requirements that attorneys serve indigent clients and that the
attorney be ‘duly enrolled’ at the time request for the certification is made.
In this week’s webcast, we’ll chat with
Blair Harrington, chair of the MSBA’s New Lawyer Section and Hannah Scheidecker,
a Mitchell Hamline 3L, about the petition’s proposed changes. We’ll talk about
policy and ethical implications of amending the rules. Plus, are the proposed
rules broad enough? Or, should they apply to second-time test takers and
out-of-state examinees?

Blair Harrington is
Employment Attorney at Taft Law; Chair of the New Lawyers Section of the MSBA.
Blair represents employers in a broad range of litigated disputes and advising
matters.
Hannah Scheidecker is
3L at Mitchell Hamline. She recently rallied students to sign a letter proposing
adoption of a broader diploma privilege.

State Bar Association. Prior to joining MSBA, Mike practiced in the area of
trademark and business with Carlson Bailey and served 10 years as Reference
Staff Attorney at Thomson Reuters.
