Lawyer Ethics in the Age of Social Media

Today, the impact of social media pervades not only our social lives, but also our professional lives. The prominence of social media creates a need for lawyers to be mindful of their ethical obligations when using social media. This presentation will identify the Minnesota Rules of Professional Conduct that are most commonly implicated by a lawyer’s online presence, such as rules governing competence, confidentiality, conflict of interest, and trial publicity. Those rules will be discussed within the context of common social media applications such as online friendships, public commentary, and dissemination of information. The goal of the presentation will be to improve awareness of a lawyer’s ethical obligations and to identify tools to appropriately use social media in consideration of those obligations.
