party releases, while still controversial, are being used by practitioners more
frequently to fully and finally resolve disputes and future contingent claims at
plan confirmation. We will discuss the constitutional foundation of third party
releases, mechanisms to address the involuntary nature of the release, and their
utility for garnering estate assets from non-debtors.
