The
FCC released a new order addressing cable franchising which became effective in
late September 2019. The Order addressed cable franchise fees, mixed use
networks, and state law preemption. The Order raises interesting legal issues
related to authorized federal agency action, ex parte communications, preemption
of local and state government, and statutory construction. The Order has been
appealed and a stay has been requested of the FCC. We will review the procedural
history before the FCC, prior litigation, the substance of the Order, and an
update
on the appeal.

begin at 12:00pm and goes until 1:00 pm.
