Program:
Life sciences and healthcare organizations must remain
vigilant at growing and evolving their data-privacy compliance programs. The
European Union’s General Data Protection Regulation (GDPR), effective since May
2018, and the new California Consumer Privacy Act (CCPA) going into effect on
January 1, 2020, impose sweeping obligations on organizations that collect
consumer data. Although the CCPA purports to exempt patient information
and clinical trial data that is governed by HIPAA and the Common Rule, a
separate examination is needed to determine where such federal law preemptions
end and new and emerging legal requirements apply.
Offering an overview of the
GDPR and the CCPA is Jeewon Serrato, who serves as Norton Rose Fulbright’s US
Head of Data Protection, Privacy, and Cybersecurity. Ms. Serrato will
discuss the scope of these regulations, rights of consumers, compliance
requirements, and enforcement. She will discuss the impact of these
regulations on HIPAA-covered organizations, and she will highlight issues such
as the FDA cybersecurity requirements for medical devices, rules regarding
clinical trials, and California’s Internet of Things security
law.
