Program:
The Minnesota appellate courts have issued several recent
decisions that could have a significant impact on the scope of
medical-malpractice liability for individual providers and health systems.
In April 2019, the Minnesota Supreme Court issued a decision in
Warren v. Dinter, which held that a physician/patient relationship is not a
required element in a medical malpractice claim and left many open questions
about the potential liability for informal consultations. In July 2019,
the Minnesota Court of Appeals confirmed that hospitals and health-care entities
are not vicariously liable for the acts or omissions of non-employed physicians,
and the Minnesota Supreme Court has granted review.
Join us for a discussion of these two cases, and the impact of
these decisions on health care providers in
Minnesota.
