Litigating a Breach of Duty of Loyalty Claim

Employers are increasingly asserting claims against former employees for breach of their common law duty of loyalty. This seminar will address questions including: What is an employee’s duty of loyalty? What is the measure of damages for a breach? Are injunctions a viable remedy? Is there a difference between fiduciary duty and duty of loyalty? Can a third party be liable for aiding and abetting? Can the claim be preempted by the Trade Secrets Act? What defenses can be asserted to this claim? Is a breach of duty of loyalty a defense to claim for wages or commissions?

Lunch will be provided. Lunch and registration begin at 11:30 a.m.

Presenters:

V. John Ella is a shareholder at the Trepanier MacGillis Battina P.A. firm in Minneapolis practicing in the area of employment law and wrongful competition. He is a certified employment law specialist and a member of the Governing Council of the Labor and Employment Law Section of the MSBA.

Shawn L. Pearson is the Assistant General Counsel, Employment & Labor for Essentia Health in Duluth.
