From FY 2006 to FY 2017, the allowance rate
at the hearing level fell from 62% to 47%. As a result, we are seeing more and
more meritorious claims denied. During that same time period, the Appeals
Council remand rate fell from 25% to 9%. This presentation will look at the
structure and operations of the Appeals Council. The focus will be on issue
identification and the effective presentation of your client's claim.

Thomas Krause | Senior Attorney | SMRLS
Thomas A. Krause worked as a staff
attorney and senior staff attorney for the Legal Services Corp. of Iowa (now
Iowa Legal Aid) for more than thirteen years. From 1997 to 2002, he represented
disability claimants at all levels within the Social Security Administration and
in federal court. From 2002 to May 2018, Mr. Krause's practice focused on
Appeals Council review and district court appeals of Social Security disability
claims. He has been the lead counsel in several class action lawsuits against
the Social Security Administration and the Iowa. Since May 2018, Mr. Krause has
been with Southern Minnesota Regional Legal Services in Winona. Mr. Krause is a
Sustaining Member of NOSSCR (National Organization of Social Security Claimants
Representatives) and served on the NOSSCR Board from 2000 to 2004 and from 2011
to 2015.
