Patent litigation venue rules have changed drastically in a
few short months after the blockbuster 2017 SCOTUS decision in TC Heartland
v Kraft, followed by a number of matters
that added further details such as the Federal Circuit’s 2017 decision in In
re Cray.
These matters have
significant business implications for patent holders and potential defendants,
including considerable differences to the impact of certain jurisdictions viewed
as friendly to patent holders such as the Eastern District of Texas. Spend an
hour with a patent litigator learning what has changed in the law, as
well as with an in-house lawyer who lived through
the In re Cray experience, where it was finally settled
that having an employee who happened to have a house just over the
border from Dallas and into the EDTX did not support venue
against Cray in the Eastern District.
Presenters:
Chris Davis is a member of the Litigation Group in Merchant & Gould's
Minneapolis office. His practice focuses on intellectual property litigation;
patent prosecution, including practice before the PTAB; due diligence, and
technology licensing. His software engineering background has been incredibly
valuable to understanding the needs of his technology clients, and to
understanding what information to seek in litigation.
Michael Fleming is Deputy General Counsel, Operations and Technology of Cray
Inc., the supercomputer manufacturer. He manages legal affairs for Cray's
litigation, intellectual property matters, commercial contracting, and a number
of other operations aspects of the company's business.
