Special Rules for Representing Noncitizen Defendants

Event Description

Deadline to Register: January 14, 2019

The MSBA Criminal Law Section is presenting this CLE for the 6th District Bar Association of Minnesota at their regular monthly meeting time in Mankato at the Mankato Golf Club.

Padilla v Kentucky (2010) defined the circumstances when criminal defense counsel must provide immigration advice to a client who pleads guilty to a crime. This CLE provides a basic understanding of immigration consequences on noncitizen defendants. The presentation will explain the legal duties of defense counsel, prosecutors, and courts when a noncitizen is charged with a crime by reviewing federal decisions, Minnesota decisions, procedural rules, and real stories from the presenter.
