The past two years have seen no shortage of
fraud and abuse developments. Innovative models in care delivery,
expansion of value-based reimbursement and increased use of technology present
both new opportunities and challenges for the industry. At the same time,
longstanding principles like fair market value and commercial reasonableness
continue to present difficulties for providers. Meanwhile, with DOJ
recoveries under the False Claims Act exceeding $2 billion for the 8th
consecutive year, health care providers and their counsel have to wonder where
enforcement agencies and False Claims Act whistleblowers will turn to
