It’s no secret at this point that we are all going to
have many more elderly clients on our hands as the generational demographics
play out. The broader legal community is justly preparing itself for the
projected increase in a particular kind of client capacity issue – Dementia.
Specific to Minnesota, the population of clients with Dementia is projected to
increase from 94,000 (2018) to 120,000 (2025) – a 27.7% increase.
While
Dementia is certainly not a brand-new medical condition, research on it and the
statistical upswing of its presence in the general population make this disease
something you should know more about. Not only that, but what are the
differences between “normal aging” and Dementia symptoms? How diminished is your
client’s capacity – and are you expected to acquire medical expertise to deal
with the elderly now? What are our professional and ethical responsibilities as
lawyers?
While our CLE aims to give attorneys already practicing in Elder
Law further resources and insight, our hope is that more general practitioners
and those in varied practice fields will recognize and find value in our
collective experiences and take away some useful tips for the next time a client
with dementia or even just an aging human walks through your door.
