Model Rule of Professional Conduct 8.4(g)
now prohibits discrimination and harassment in all conduct related to the
practice of law. Our presenters will discuss attorneys’ ethical obligations in
the context of eliminating bias, fostering inclusion and professionalism, and
avoiding "bad behavior" that can now rise to the level of a breach of the rules
of professional conduct.
Lunch and registration will begin at 12:00 PM. The program
will begin shortly thereafter and is expected to end at 1:30 PM.

Kristine Kubes

At the core of Kristine’s practice is her value of
relationship. She is attentive to the human side of conflict, committed to
having her clients come through the dispute process better and stronger than
when they started. Kristine is a seasoned construction attorney recognized
for her skill in leadership, clear communication, and thinking outside the
box. She has demonstrated strength in managing litigation, trying cases,
negotiating settlements, handling appeals. Kristine represents architects,
engineers, designers, building and road contractors, and their sureties. She
defends professional liability and general liability claims. In addition, she
secures client’s payment claims via mechanic’s liens and contract claims. A
proactive counselor, Kristine assists her clients in managing and minimizing
risk by preparing and negotiating contracts, navigating project management and
payment issues during contract performance, and evaluating and implementing best
practices during the life of the construction and design process. Kristine
also mediates construction and design disputes, fueled by a passion for helping
people feel heard and understood, breaking down barriers, and finding ways to
resolve problems or claims more effectively. Kristine is an AV-rated
attorney.
Mary
Schwind | Kubes Law
Mary has over twenty years of experience in representing
design and construction professionals on matters ranging from contract drafting
and review to arbitration, mediation and litigation. She is a creative problem
solver and focuses her energy on helping clients achieve their goals in a
positive, cost-effective way. Before joining Kubes Law Office, PLLC as special
counsel, Mary was a shareholder at Stinson Leonard Street (formerly Leonard
Street and Deinard) for many years where she chaired the firm’s Construction Law
Practice Group and served on the firm’s Board of Directors. Mary is a past
president of the Minnesota State Bar Association’s Construction Law Section, has
been named a Super Lawyer in Construction and Surety Law and was named a
“Litigation Star” by Benchmark Litigation. Mary is a frequent lecturer on
construction law topics, including mechanic’s liens, foreclosures and
construction contracting; she is a general editor of the Federal Practice
Deskbook and a long-time contributor to the Minnesota Civil Practice Deskbook.
The Minnesota Justice Foundation recognized Mary for her outstanding pro bono
work on behalf of Hmong women. For the past several years, Mary served as Career
Clerk to federal Magistrate Judge Janie S. Mayeron (District of Minnesota),
where she worked on hundreds of civil matters touching on thorny legal issues
bearing on jurisdiction, federal procedure, patent and trademark infringement
and anti-trust.
