Padilla v Kentucky defined the circumstances when criminal defense counsel must provide immigration advice to a client who pleads guilty to a crime. This CLE will go beyond the holding and address practical challenges that defense counsel, prosecutors, and the courts have encountered since the decision. What is a "truly clear" deportation consequence? What form should any immigration advice take? What types of pleas avoid immigration consequences? How to withdraw a plea?
