Closing Gaps in the International Anti-Corruption Regime

Unchecked corruption undermines efforts to fight poverty and restore human rights. Investigators struggle to trace corrupt payments. The current regulatory regime permits corrupt individuals to hide transactions by using third-parties posing as beneficial owners to transmit illicit funds to offshore accounts. Professor Stuart Yeh has proposed changes in international law involving a model international convention that seeks to close gaps in the current enforcement regime. This program will explore the existing gaps, the legal bases for Professor Yeh’s proposed treaty, and the treaty’s potential impact on international businesses.

Stuart Yeh focuses on issues related to international poverty, human rights, governance, and rule-of-law. He has authored multiple articles addressing issues raised by the model international convention, including articles published in International Affairs; International Criminal Justice Review; International Public Policy Review; Poverty and Public Policy; and the South Carolina Journal of International Law and Business.
 
Moderator: Karl C. Procaccini, Chair, MSBA International Business Law Section
Karl Procaccini is a partner at Greene Espel PLLP, where he focuses on investigations, compliance, and litigation. Procaccini conducts due diligence and internal investigations related to anti-corruption laws and advises on interactions with related government agencies. He also helps his clients build effective and efficient compliance programs.
