Elections:
The Art & Entertainment Section Annual
Meeting and Elections will be held on Wednesday, June 27, 2018 from 12:30 pm - 1:00 pm,
follow by the CLE program. Please join us for lunch beginning at 12
noon. At this meeting, the section will conduct officer elections for the 2018 - 19
bar year and discuss plans for the upcoming year. All section
members are encouraged to attend and vote. Remote participation is available for
those who cannot attend the annual meeting in person.

Description:
E Sports is defined as a
multiplayer video game played competitively for spectators, typically by
professional gamers. Huge games you may have heard of includes League of
Legends, World of War Craft, Counterstrike, and Rocket League. These games,
combined have generated millions of dollars in prizes and sponsorships and is
anticipated to reach 1.5 billion by 2020. Along with that comes a lot of
legalities that require a closer look. A panel will give an introduction to E
Sports and provide insight into the fast growing sport including relevant
publishing and IP rights, sponsorship contracts, and league governance. The
panel will further tackle how to develop a practice around the teams, players,
sponsors, and leagues in the burgeoning industry.

Joshua Schaub : Attorney at Gutwein
Law, and MSBA Art & Entertainment Law Section Secretary
Josh will give brief
introductory remarks and update attendees on the Art & Entertainment Section
programming development and collaboration. He will also help lead the panel.
Josh focuses his law practice primarily on general corporate and international
Sports and Entertainment Law. Within Sports Law, he works with major, minor, and
collegiate leagues and teams all over the world that are seeking ways to operate
more efficiently and effectively, increase league revenue and team valuations,
and ultimately, grow through high-level legal counsel. The advice Josh gives his
clients is rooted in more than a decade of experience in the sports industry. As
Commissioner of the Major Arena Soccer League, Co-Founder of Da Beauty League,
former CEO/Co-Owner of the Joliet Slammers, and Associate Scout at the Milwaukee
Brewers Baseball Club, Josh brings a wealth of knowledge and experience on all
sides of the table to Gutwein Law’s Sports Law practice.
Faculty:
Krista Hiner: Attorney at ESG
Law
Krista graduated from William Mitchell College of Law in 2010 and joined the
law firm of Peterson, Logren & Kilbury in St. Paul where she where she
focused her practice on litigation, general counsel, and transactional work
related to the management-side of employment and workplace disputes. She also
counseled local tournament producers, authored gaming blog articles, and was
involved in the production of local gaming events. In 2017, Krista joined ESG
Law, the world’s first dedicated esports law firm, merging her years-long
passion for gaming with her experience in the legal field. At ESG, Krista
represents preeminent esports teams, talent, and institutions. She handles
significant work relating to talent contracts, internal staff, general business
matters. She further advises on employment law and general business matters,
supports the fast growing infrastructure of the esports industry, and
contributes to esports op-eds for ESPN.
Ryan Fairchild : Brooks Pierce, Wilmington, NC
Ryan represents esports players, organizations, and stakeholders in
negotiating and drafting contracts, structuring intellectual property
protections, and addressing corporate matters. His passion for esports
derives from being a lifelong gamer, having played most of the games currently
at the forefront of esports (e.g. DotA 2, Counterstrike, Hearthstone,
etc.). Ryan understands the various esports ecospheres, cultures and
dynamics, and the legal problems that those in the industry face.
Harris Peskin : Attorney at ESG Law
Harris is an Associate Attorney at ESG Law, the leading law firm in the
esports industry. With ESG, Harris represents seven of ten North American League
Championship Series teams, six of twelve Overwatch League and their non-endemic
partners, such as the owners and ownership groups of Philadelphia 76ers, New
Jersey Devils, Colorado Rockies, Texas Rangers, Cleveland Cavaliers, Golden
State Warriors, and several others. Harris has worked directly with game
developers and league operators to negotiate for fairer revenue sharing and
governance agreements on behalf of ESG's clients. He has also played an
important role in working on some of the industry's largest sponsorship deals,
player contracts and player transfers, in addition to numerous other
transactional matters. Harris is the first attorney to file an EB-1A visa
application on behalf of an esports player. Prior to joining ESG, Harris worked
as the Chief of Operations and Association General Counsel for H2K where he
helped broker one of the largest acquisitions of a European based team. In his
career, Harris has contributed to notable publications like ESPN, and the Daily
Dot, where he has written about important topics such as governance and esports
economics. Harris has led marketing efforts that have garnered international
attention and appeared in notable publications like ESPN, Yahoo News, The Score,
and several other major news providers.
